🐧 Penguin Couple Terms of Service

Welcome to Penguin Couple! These Terms of Service ("Terms") govern your use of the Penguin Couple mobile application ("App") operated by Penguin Couple ("we", "us", or "our").

By downloading, installing, or using Penguin Couple, you agree to be bound by these Terms. If you do not agree, please do not use the App.

Effective Date: February 7, 2026

1. Acceptance of Terms

By accessing or using Penguin Couple, you confirm that:

You are at least 13 years of age
You have the legal capacity to enter into a binding agreement
You agree to comply with these Terms and all applicable laws

2. Description of Service

Penguin Couple is a couples' connection app that enables partners to:

Connect and link accounts using unique partner codes
Exchange messages, scribbles, and drawings in real-time
Initiate and receive end-to-end encrypted audio and video calls exclusively with your connected partner
Share photos, videos, and voice recordings
Play interactive games (Tic Tac Toe, Wordle, Jigsaw Puzzles)
Complete daily challenges and relationship questions
Share mood status and activity updates
Use home and lock screen widgets to stay connected (including displaying the distance between you and your partner)

3. Account Registration

3.1 Account Creation

To use Penguin Couple, you must create an account using:

Google Sign-In, or
Apple Sign-In

You agree to provide accurate, current, and complete information during registration.

3.2 Account Security

You are responsible for:

Maintaining the confidentiality of your account credentials
All activities that occur under your account
Notifying us immediately of any unauthorized use

3.3 Partner Connection

Penguin Couple is designed for couples. When you connect with a partner:

Your selected content will be shared with your partner
You may only place audio and video calls to or receive calls from your linked partner (calling unlinked accounts or third parties is not supported)
Your mood, online status, and game activity will be visible to your partner
If location permissions are granted, your location and/or calculated distance will be used to update widgets on your partner's device
You consent to receiving messages and content from your partner

4. User Conduct

4.1 Acceptable Use

You agree to use Penguin Couple only for lawful purposes and in accordance with these Terms.

4.2 Prohibited Activities

You agree NOT to:

Use the App to harass, abuse, stalk, or harm another person
Record, screenshot, or broadcast audio/video calls without your partner's explicit consent
Share illegal, harmful, threatening, or abusive content
Upload content that infringes intellectual property rights
Attempt to gain unauthorized access to our systems
Use automated means (bots, scrapers) to access the App
Impersonate any person or entity
Share your account credentials with others
Use the App for commercial purposes without authorization
Circumvent, disable, or interfere with security features

4.3 Content Standards

All content you create and share must:

Be created by you or you have the right to share it
Not contain illegal material
Not infringe on others' rights
Not contain malware or harmful code

5. User Content

5.1 Ownership

You retain ownership of all content you create and upload to Penguin Couple, including messages, photos, scribbles, and recordings.

5.2 License Grant

By uploading content, you grant us a non-exclusive, royalty-free, worldwide license to:

Store, process, and display your content to provide the service
Share your content with your connected partner as intended
Create backups and maintain system integrity

This license ends when you delete your content or account, except where retention is required by law.

5.3 Content Removal

We reserve the right to remove content that violates these Terms without prior notice.

6. Intellectual Property

6.1 Our Property

Penguin Couple and its original content, features, and functionality are owned by us and are protected by:

Copyright
Trademark
Patent
Other intellectual property laws

6.2 Restrictions

You may not:

Copy, modify, or create derivative works of the App
Reverse engineer, decompile, or disassemble the App
Remove any proprietary notices from the App
Use our trademarks without written permission

7. Third-Party Services

Penguin Couple integrates with third-party services:

Apple	Authentication (iOS)
Amazon Web Services	Media Storage

Your use of these services is subject to their respective terms of service.

8. Privacy

Your privacy is important to us. Please review our Privacy Policy for information on how we collect, use, and protect your personal data.

9. Disclaimers

9.1 "As Is" Service

PENGUIN COUPLE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO: MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AVAILABILITY OR RELIABILITY.

9.2 No Guarantee

We do not guarantee that:

The App will be uninterrupted or error-free
Defects will be corrected
The App is free of viruses or harmful components
Results from using the App will be accurate or reliable

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
WE SHALL NOT BE LIABLE FOR LOSS OF PROFITS, DATA, OR GOODWILL
OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US (IF ANY) IN THE PAST 12 MONTHS

11. Indemnification

You agree to indemnify and hold harmless Penguin Couple, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:

Your use of the App
Your violation of these Terms
Your violation of any third-party rights
Content you create or share

12. Termination

12.1 By You

You may terminate your account at any time by:

Using the "Delete Account" feature in the App
Contacting our support team

12.2 By Us

We may suspend or terminate your account if you:

Violate these Terms
Engage in prohibited activities
Create risk or legal exposure for us

12.3 Effect of Termination

Upon termination:

Your right to use the App ceases immediately
Your data will be deleted in accordance with our Privacy Policy
Provisions that by nature should survive will remain in effect

13. Subscriptions & In-App Purchases

13.1 Premium Features

Penguin Couple may offer premium features, enhancements, or auto-renewable subscriptions ("Subscriptions"). Features, duration, and pricing will be clearly displayed in the App prior to purchase.

13.2 Payment & Auto-Renewal

Payment Charging: Payments will be charged to your Apple ID Account (for iOS users) or Google Play Account (for Android users) upon confirmation of purchase.
Automatic Renewal: Subscriptions automatically renew unless auto-renew is turned off or canceled at least 24 hours before the end of the current billing period.
Renewal Billing: Your account will be charged for renewal within 24 hours prior to the end of the current active subscription period at the cost of the selected plan.

13.3 Managing & Canceling Subscriptions

You can manage, modify, or cancel your auto-renewable subscriptions at any time through your device account settings:

iOS Users: Go to Device Settings > Apple ID > Subscriptions.
Android Users: Open Google Play Store > Profile > Payments & Subscriptions.

Canceling a subscription prevents future recurring charges. You will continue to have access to paid premium features until the end of your current active billing period.

13.4 Refunds & Free Trials

Refunds: All payments and refunds are handled exclusively by Apple or Google in accordance with their respective Store refund policies.
Free Trials: Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription to that feature or plan, where applicable.

14. Modifications to Service

We reserve the right to:

Modify or discontinue any feature at any time
Update the App to improve functionality
Change pricing or introduce paid features (with notice)

We will provide reasonable notice of significant changes.

15. Changes to Terms

We may update these Terms from time to time. We will notify you of changes by:

Posting the updated Terms in the App
Updating the "Effective Date" above
Sending in-app notifications for material changes

Continued use after changes constitutes acceptance of the updated Terms.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles.

17. Dispute Resolution

17.1 Informal Resolution

Before filing any claim, you agree to contact us and attempt to resolve the dispute informally for at least 30 days.

17.2 Arbitration

If informal resolution fails, disputes shall be resolved through binding arbitration in Patna, Bihar, India under the Indian Arbitration and Conciliation Act, 1996, except for disputes that qualify for small claims court.

18. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force and effect.

19. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Penguin Couple regarding the App.
